This is an agreement between you and Bedrock Solutions, LLC (“Bedrock”, “us” or “we). Before using the Bedrock service (“Service”), please read these terms, and all rules and policies related to the Service and the Bedrock Privacy Notice (collectively, the “Terms of Use”) If you use the Service you will be bound by the Terms of Use.

1. The Service. Bedrock offers fund raising services (“Service”) for schools through the sale of digital downloads of audio recordings, artwork and other information and content related to those audio recordings (individually and collectively, "Digital Content").

2. Your Account. If you use this website, you are responsible for maintaining the confidentiality of your account and password and restricting access to your computer, and you agree to accept all activities that occur under your account or password. If you are under the age of 13, you may use wearebedrock.com only with the involvement and written approval of a parent or guardian.

3. Communications

3.1 When you visit wearebedrock.com or send e-mails to us, you are communicating with us electronically. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

3.2 You may send emails from the Site to potential purchasers of the Digital Content provided the content of those emails is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not contain software viruses, political campaigning, commercial solicitations, chain letters, mass mailings or any form of “spam”. You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any such email.

4. Copyright  

4.1 All content included on this website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Bedrock or its content suppliers and protected by United States and international copyright laws.

4.2 If you believe that your work has been copied or exploited in a way that constitutes copyright infringement, please follow our Notice and Procedure for Making Claims of Copyright Infringement.

5. Digital Content

5.1 Upon your payment of our fees for Digital Content, we grant to you a non-exclusive, non-transferable right to use the Digital Content for your personal, non-commercial, entertainment use. You may copy, store, transfer and burn the Digital Content only for your personal, non-commercial, entertainment use. You agree not to infringe the rights of the Digital Content's copyright owners and to comply with all applicable laws in your use of the Digital Content.

5.2 You agree that you will not redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, license or otherwise transfer or use the Digital Content except as set forth in section 5.1. You also agree that we have no liability to you for Digital Content you find to be offensive, indecent or objectionable.

6. All Sales Final; Downloading and Risk of Loss. All sales of Digital Content are final. We do not accept returns of Digital Content. You bear all risk of loss after purchase and for any loss of Digital Content you have downloaded, including any loss due to a computer or hard drive crash.

7. Termination; Amendments. Your rights under the Terms of Use will automatically terminate without notice from us if you fail to comply with any of its terms. In the event of termination, you must cease all use of the Service, and we may immediately revoke your access without notice. Our failure to insist upon or enforce your strict compliance with the Terms of Use will not constitute a waiver of any of our rights. We may amend any of the Terms of Use at our sole discretion by posting the revised terms on the Bedrock website.

8. Third-Party Beneficiaries. Digital Content copyright owners are intended third-party beneficiaries under the Terms of Use and may enforce the Terms of Use against you and invoke all rights hereunder including limitations of liability.

9. Disclaimer Of Warranties And Limitation Of Liability THIS SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE ARE PROVIDED BY BEDROCK ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. BEDROCK MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE, UNLESS OTHERWISE SPECIFIED IN WRITING. 10. Damages Cap. Without limiting the Disclaimer of Warranties and Limitation of Liability above: (i) in no event will our or our licensors' total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) arising out of or related to your use or inability to use the Service or the Digital Content exceed the amount of fifty dollars ($50.00); and (ii) in no event will our or our Digital Content providers' total liability to you for all damages arising from your use of the Service, the Digital Content, or information, materials or products included on or otherwise made available to you through the site exceed the amount you paid to purchase the Digital Content related to your claim for damages. These limitations will apply to you even if the remedies fail of their essential purpose.

11. Applicable Law. By visiting wearebedrock.com, you agree that the laws of the state of Texas, without regard to principles of conflict of laws, will govern the Terms of Use and any dispute of any sort that might arise between you and Bedrock. Any dispute relating in any way to your visit to wearebedrock.com will be adjudicated in any state or federal court in Travis County, Texas, and you consent to exclusive jurisdiction and venue in those courts.

When you provide Bedrock Solutions, LLC (“Bedrock”, “us” or “we”) with information through wearebedrock.com (“Site”) we respect your privacy. It is important for you to understand what information we collect about you during your visit and what we do with that information. By using this Site, you agree to the terms of this notice. 

1. Information you provide to Bedrock. When you register with the Site you provide us with your name, email address, city, state, birth date and the name of the school you attend.

2. Information Bedrock collects. We collect some of your information such as your IP address, browser type, how you maneuvered through the Site or emails you may have sent from the Site to potential donors. We also collect the name, shipping address, billing address, telephone number, email address and credit card information from any purchaser of content from the Bedrock site. We do not store credit card information on our database.

3. Security. When you enter sensitive information (such as a credit card number or a password) we encrypt that information. We implement various security measures in accordance with industry standards to protect the security of your personal information both online and offline. Please keep in mind that no Internet transmission is ever completely secure or error-free. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

4. Children under the age of 13. If you are under the age of 13, please do not attempt to register with the Site or provide any personal information about yourself. If we learn that we have collected personal information from a child under the age of 13, we will delete that information as quickly as possible. If you believe that we might have any information from a child under the age of 13, please contact us.

5. Links to other websites. The Site may contain links or references to other websites to which this Privacy Policy does not apply. Please be aware that we are not responsible for the privacy practices of other websites. This Privacy Policy applies only to the information we collect on the Site.

6. Choice/Opt-out. You may opt-out of receiving future opt-in communications from Bedrock when you register at the Site or otherwise provide your contact information to the Site. You may change your preferences at any time by revising your profile by contacting us or clicking the "unsubscribe" link at the bottom of any email opt-in communication you receive from us and following the instructions provided therein.
